SYSTEM RULES AND REQUIREMENTS.
Terms used below shall be as defined in the Agreement.
I. CONTENT
Without limiting its other obligations under the Agreement, User shall not, and shall not permit any other party to:
(a) post, upload or transmit any Content to the System:
(i) that is offensive, unlawful, threatening, libelous, defamatory, obscene, scandalous, inflammatory, pornographic, or profane material, or any other material that could give rise to any civil or criminal liability under the law, including but not limited to that which contains sexual implications, racial slurs, gender-specific comments, or that addresses someone's age, sexual orientation, religious or political beliefs, national origin or disability, or that is invasive of another's privacy (including any photo, address, email, phone number, or any other contact information without the written consent of the owner of such information), hateful, or racially, ethnically, or otherwise objectionable;
(ii) that may harm minors in any way;
(iii) that User does not have a right to transmit under any law or under contractual or fiduciary relationships on an unrestricted basis, including but not limited to inside information, or proprietary and confidential information, information learned or disclosed as part of employment relationships or under nondisclosure agreements;
(iv) of a personal nature, including but not limited to personally identifiable information such as photographs, videos, or other images whether of User or others;
(v) that infringes any patent, trademark, trade secret, copyright, rights of privacy or publicity, or other proprietary rights of any party;
(vi) that is unsolicited commercial email or "spam", which includes, without limitation, unethical marketing, advertising, or any other practice that is in any way connected with "spam," such as (A) sending mass email to recipients who have not requested email from User or with a fake return address, (B) promoting a site with deceptive or otherwise inappropriate links, titles, descriptions, or (C) promoting User’s web site(s) by posting multiple submissions in public Systems that are identical, or consists of chain letters or pyramid schemes;
(vii) that contains viruses, or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment; interferes with or disrupts the System or servers or
networks connected to the System, or violates any requirements, procedures, policies, or regulations of networks connected to the System;
(viii) that is commercially sensitive, such as but not limited to prices or terms and conditions, except in connection with posting Work for sale or making an offer to purchase Work posted for sale on the System;
(ix) that is false, fictitious, or misleading;
(b) impersonate any person or entity, including, but not limited to, a Siemens Energy or Other User official, System personnel, guide, or host, or falsely state or otherwise misrepresent affiliation with a person or entity, including Siemens Energy or any Other User;
(c) forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through the System;
(d) violate any applicable local, state, national, or international law;
(e) "stalk" or otherwise harass any person
(f) breach or attempt to breach the security of software, network, servers, data, computers or other hardware relating to the System or that of any other User or third party that is hosting or interfacing with any part of the System, or use or distribute on the System software or other tools or devices designed to compromise privacy or security;
(h) post for sale any item that is not Work;
(i) post for sale any other item that Siemens Energy, in its sole discretion, deems inappropriate for the System;
(j) post advertising material, whether related to User or otherwise, other than such material as is permitted in this Agreement to describe Work posted for sale by the User;
(k) post statements or material that encourages criminal conduct or that would give rise to civil liability or otherwise violate any law or regulation in any jurisdiction;
(l) post statements or material that constitutes anti-competitive collaboration and/or antitrust law violations; or
(m) post any information the posting of which on the System or the transfer of any Works for sale on the System would violate any law, including any Sanctions Laws.
All Content shall be in the English language, and all prices in United States dollars.
II PROHIBITED CONDUCT
Without limiting its other obligations pursuant to this Agreement, User shall not, and shall not permit any other party to:
(a) Violate the privacy rights of Other Users;
(b) Alter or tamper in any way with the software or the look, feel or functionality of the System;
(c) Violate Siemens Energy's or its third party licensors' rights, if any, in the Siemens Energy Intellectual Property (as defined below) or any information concerning the business or affairs of Siemens Energy or any other User, or information concerning any transaction conducted via the System;
(d) Reproduce, copy, translate, modify, adapt, distribute, transmit, transfer, republish, modify, compile or decompile, reverse engineer, distribute, transmit, display, remove or delete the content and information provided by Siemens Energy Parties, or provided by Other Users on the non-public area of the System;
(e) Allow unauthorized disclosure or copying of any part of the System or any information obtained from the System;
(f) Allow access to or use of the System by any third parties including, without limitation, to provide timeshare services, service bureau services, outsourcing or consulting services or for any unlawful purpose;
(g) Engage in any conduct that, in Siemens Energy's sole discretion, restricts, inhibits or impacts any Other User from using or enjoying the System;
(f) Promote or provide instructional information about illegal activities, promote physical harm or injury against any group or individual, or promote any act of cruelty to animals. This may include, without limitation, providing instructions on how to assemble bombs, grenades, or other weapons or incendiary devices;
(h) Interfere with, attempt to interfere with or in any manner compromise any of Siemens Energy’s security measures applicable to the System;
(i) Use the System for fraudulent purposes;
(j) Harvest or collect any information about or regarding Other Users, including, without limitation, any personal data or information;
(k) Remove any copyrights or proprietary notices;
(l) Sell, assign, rent, lease, act as a service bureau, or grant rights in the System including, without limitation, through sublicense, to any other person or entity;
(m) Attempt to decompile, reverse engineer, disassemble, modify, or hack the System, Content or underlying software, or to defeat or overcome any encryption and/or digital rights management technology implemented by Siemens Energy with respect to the System, Content and/or data transmitted, processed, or stored by Siemens Energy;
(n) Utilize the System to notify or purport to notify Siemens Energy of (i) contractual or other claims, disputes, contract or legal questions or issues (such as but not limited to warranty or other claims), (ii) allegations of regulatory or legal violations, or (iii) matters requiring urgent or immediate attention or response, such as, but not limited to, matters related to personnel or plant safety, outage related critical path items, or requests for urgent services, and User expressly agrees that any Content containing the forgoing shall be ineffective for purposes of providing such notification; or,
(o) Advertise or conduct gambling, giveaways, raffles, drawings, games of chance, prizes, in connection with the sale of Work.
